MAHI App Terms of Use

We at CreditAccess Grameen Limited (“our”, “us”, “we”, “Company”, “CA Grameen”) have developed MAHI, a mobile application (“App”) and are happy to have you with us. Please read these terms of use (“Terms”) carefully before you use the App since they constitute the agreement between you and us. For the purpose of this TERMS OF USE, the Users of the App or Services may be “Customer” or any other persons using the App or Services or accessing the App (“Customer”, “User” or “you” or “your” or “yourself”).

By accessing or using the App/ Services, you agree (on behalf of yourself and your co-applicants, members, nominees, if any) to be bound by these Terms and use of your information as set forth in the Privacy Policy.

All our Services are subject to applicable laws, government notifications, the rules, regulations and guidelines issued by the Reserve Bank of India (“RBI”) and any other regulatory body/bodies defining the rules/regulations governing the offer of any Services on the App.

We may revise these Terms as well as update the App and Services from time to time, so please keep visiting this page regularly. If you do not agree with any part of these Terms, please stop using the App immediately. For any grievances, please contact our grievance officer as provided in clause 11 below

We help you access financial products, primarily loans and insurance products in a simple, convenient manner. You may use our Services only if you are legally permitted to do so under applicable laws. If we discover that any person using our Services is not capable of entering into a legally binding contract, we may immediately terminate your access to our App.

1. SCOPE OF SERVICES

We offer financial services including loans, insurance, payments directly or through partnership with other entities through the App. You must be legally permitted to enter into a contract and provide the information and permissions we need as prompted or asked in the App.

You explicitly declare that my age is between 21-65 years at the time of applying for any services in the App and I possess valid KYC documents. You are also an Indian citizen with no criminal cases pending against and are not a member of any banned organization.

Through the App, the Company will enable you to avail various types of loans subject to the eligibility and underwriting criteria of the Company which could change from time to time based on Company’s credit policy. The Company will enable a seamless and paperless process to make it simple and convenient for the User to avail our services. You declare that the particulars and information provided by you are true, correct, complete and up-to-date in all respects and that you have not withheld any information. Company shall be at liberty to reject my/our application at any stage of processing the application for loan, without providing any reason thereof. You also agree and accept that the Company shall have every right to share your information with any Financial Institution/Bank/Credit Information Company/RBI/SRO during the process of processing your application.

Credit limit displayed, if any, on the App is an estimated eligible loan amount computed based on the inputs provided by you in the App, Company’s internal credit norms and policies applicable at the relevant point of time etc. Any such display of amount is an undetermined amount and does not constitute a loan sanctioned to you. Sanction of loan is at the sole discretion of the Company upon the Company receiving your application for a specific loan and any such sanction of loan will be only after following all due process of credit underwriting which is subject to, including but not limited to, the internal credit norms, policies, regulatory provisions etc. applicable at the relevant point of time.

Loan amounts will be disbursed and credited directly into the Customer’s bank account registered with the Company either through the App or through our branches in offline mode. Responsibility of providing the correct bank account number rests solely with the Customer and the Company doesn’t take any responsibility of credit of loan account into a bank account incorrectly provided by the Customer.

For certain loans, when prompted by the App, you will be required to issue appropriate auto-debit instructions for your bank account to repay the loan amount, prior to the processing of loan disbursal. These cannot be changed or cancelled during the tenor of the loan. The App will display the details of the EMI, including the due date and amount payable, as well as whether your payment was received or not.

For loans taken through the App, Details of the loan such as Sanction Letter, Key Fact Sheet, Loan Agreement, Repayment Schedule, Repayment History, Current Balance and other details of your loan will be available on the App. Given these reasons and for facilitating a seamless digital lending journey, you are advised not to remove the App from your mobile device until the loan has been completely repaid and closed. In case you need to remove the App from your mobile device, please write to us at digital.support@grameenkoota.in. The Customer support team will reach out to help you with this. Please note, however, that fraudulent deletion of the App with an intention to avoid repayment of the loan shall amount to breach of these Terms and conditions mentioned herein.

When a loan is approved, you will also become eligible for cover under our group term life insurance policy. Subject to you opting for such insurance cover and deduction of premium, coverage and benefits under the policy shall be available during the term of the policy.

We reserve the right to store information on your device in the form of cookies or similar file for purposes of modifying the App to reflect your preference. The App is deemed to be in use when it is loaded in a temporary or permanent memory of your device.

At the time of registration, your information is required to verify your identity and to complete registration in the app. We collect information about the device you use to access our services, including your device’s unique ID i.e. operating system version, SDK version and mobile network information including carrier name, phone number, SIM Serial and SIM Slot, so as to uniquely identify the devices and to ensure no unauthorised device acts on your behalf, which helps us in preventing fraud. Additionally, we may automatically receive and gather certain anonymous information from standard usage logs on the web server, such as mobile-identification data obtained from the app’s version of cookies, information about your mobile network, data from regular web logs, traffic to and from our app, data about how you use the app, and any other data that is made accessible by your device’s IP address. As permitted by law, we may keep your information as long as it’s required to resolve disputes, offer customer assistance, and troubleshoot issues. In addition to the above, we also track and collect data related to the performance of the application and other diagnostic data for identifying and resolving any technical glitches that may be identified from such data and also for improving the overall functionality of the application to provide a personalised user experience to you.

Final decision of loan approval, and offer of other financial services rests solely with the Company. In addition to these terms and conditions, all products availed through this App will also be governed by the agreements signed as part of the product agreement.

2. YOUR OBLIGATIONS

You must always provide us with correct information, keep your mobile device secure, be responsible for all costs in case we suffer any damages or claims owing to your use of the App, keep the App updated.

a. Duty to provide true information: The information you provide is used by us, our Affiliates to determine your eligibility for our Services. It is critical that all information you provide to us are true, complete, not misleading and are regularly updated by you. If all or any part of this information is incorrect, incomplete, fraudulent or misleading, it would be a breach of these Terms and a violation of the law. You must further ensure that you do not do anything that make the information provided by you incorrect, incomplete, fraudulent or misleading at a later date. If you discover any information provided is incorrect, incomplete, fraudulent, misleading or provided without adequate authority, then please write to us immediately at digital.support@grameenkoota.in.

b. Duty to be responsible: Considering the nature of the App and Services provided, please ensure that you keep your mobile device safe. You are solely responsible for all activities that occur under your credentials on the App. You should keep your password, mPIN, OTP and other access controls safe and not disclose your MAHI / CA Grameen account details to any third party or share the account with any third party. If you think someone has gained access to your MAHI / CA Grameen account, please contact us at digital.support@grameenkoota.in immediately.

c. Obligation to indemnify: To the extent permitted under applicable law, you agree, to indemnify us (i.e., the Company), our Affiliates, directors, agents, and employees from and against all complaints, demands, claims, damages, losses, costs, liabilities and expenses, including attorney’s fees, due to, arising out of or relating in any way to (a) your access to or use of the App and/or Services; (b) your breach of these Terms; (c) your breach of any applicable laws or third-party rights; and/ or (d) any act of fraud or misrepresentation.

d. Ensure compatibility and keep updated: You must ensure that you keep updating the App as and when we release new versions of it. Failure to do so may make you incapable of using certain Services, features or the App altogether.

3. RESTRICTIONS ON YOU

You shall not hack or in any way jeopardize the App. You should not use the App for any forward lending purposes or to grant loans to any third parties. You should not use the App/Services for any illegal purposes.

a. No scaling or jeopardizing our platform: You agree to not interfere with or use non-public areas of our App and our technical delivery system. You will not introduce any trojans, viruses, any other malicious software, any bots or scrape our App for any User information. Additionally, you will not probe, scan, or test the vulnerability of any system, security or authentication measures implemented by us. If you tamper or attempt to tamper with our technological design and architecture, we may terminate your MAHI Account. We may further report such actions to the appropriate law enforcement authorities and initiate legal actions.

b. No commercial usage: You shall use the Services only for your lawful and personal use. You will not use the App or our Services for any purposes not permitted under applicable law and these Terms.

c. No illegal usage: You shall not use the App or the Services for committing fraud, embezzlement, money laundering, terrorist financing or for any other unlawful and/or illegal purposes. Further, although we may, from time to time, monitor or review any facilities, if established or otherwise offered on the App for discussions, chats, postings, transmissions, bulletin boards, and the like on the App, you are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law for the time being in force. We are under no obligation to do so and assume no responsibility or liability arising from the content of any such locations nor for any error, defamation, libel, slander, omission, falsehood, obscenity,pornography, profanity, danger, or inaccuracy contained in any information contained within such locations on the App. We will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone posting any such information or materials.

d. Maintenance of accounts: You shall not do any action that may jeopardize the MAHI / CA Grameen Account or in any way frustrate the repayment of the loan amounts as may be disbursed to you.

4. INTELLECTUAL PROPERTY

We own the content on the App. You cannot duplicate or commercially exploit the App or its content.

a. All of the content on the App, including its images, illustrations, graphics, video clips, text, reports generated, trademarks, as well as the underlying code of the App (“App Content”), constitutes our intellectual property.
b. We give you a limited, non-transferrable, non-sublicensable and revocable license to access the App, avail of the features of the App for your personal, lawful requirements only. You are not entitled to duplicate, distribute, create derivative works of, display, or commercially exploit the App content, features or facilities, directly or indirectly, without our prior written permission.

5. REGULATORY CHANGES

Financial technology is an evolving sector. This may lead to changes in law and regulations which may lead to us to modify the App or shutting it down.

Regulation around technology and related services is ever changing. You understand that the Company may have to modify the Services as well as the App on account of the regulatory landscape we are subject to. In such case, if you become incapable of using all or any part the App or the Services, the same shall not be our fault.

6. THIRD PARTY LIABILITY

In order to provide you with a working ecosystem, we collaborate with various third parties. These third parties have their own protocols, terms of use and privacy practices. We cannot be responsible for their activities.

In providing the Services to you, we needs to use third-party services. This is done to facilitate checking your credit score, facilitating payment to and from you and other practical and functional purposes in order to enhance the Services we provide You. While we have appropriate agreements in place with these third parties, we do not accept any liabilities that may arise from our use of or reliance on such third-party services.

7. TERMINATION

We may terminate your MAHI Account by informing you by email/SMS. However, you shall continue to make the payments/ repayments/ premiums owed to us as agreed under the respective documents/policies.

If we decide to terminate your MAHI Account for any reason, we will inform you of such decision on the App or by email/ SMS. However, this will not extinguish your obligations under the applicable documents/policies. We will not be liable for any losses or damages that you may suffer from such termination of your MAHI Account.

8. OPT-OUT REQUEST

Email us at digital.support@grameenkoota.in to opt out of receiving any updates from us.

Users who have availed our Services may not, prior to such Services being completed/closed, either uninstall the App or deactivate their MAHI Account due to the reasons provided in these Terms. Such Users may further note, that in the event you either delete the App and/or deactivate your account, at any point prior to the closure of the respective Services, such an act will not extinguish your responsibilities under the applicable documents/policies.

If the User, does not want to continue using our App and the Services and/or wants to deactivate their MAHI Account, and/or unsubscribe from the mailing lists, they may do so by contacting us at- digital.support@grameenkoota.in.

9. FORCE MAJEURE

We shall not be held responsible for any deficiency or loss of Services owing to any reasons outside of our control.

Without limiting the foregoing, under no circumstances shall we be held liable for any damage, loss, loss of services of App, due to deficiency in provision of the Services resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, internet failures, computer equipment failures, telecommunication equipment failures, or any other government regulations, floods, storms, electrical failure, civil disturbances, riots, etc.

10. DISCLAIMERS AND LIMITATIONS

Our liability is limited. The services are provided on an “as is” basis. No warranty of uninterrupted or error free service.

The App and Services are provided on an “as is” basis without any representation or warranties, express or implied except otherwise specified in writing. We do not warrant the quality of the Services or the App, including its uninterrupted, timely, secure or error-free provision, continued compatibility on any device, or correction of any errors. In no event shall we or any of our Affiliates, successors, and assigns, and each of their respective investors, directors, officers, employees or agents be liable for any special, incidental, punitive, direct, indirect or consequential damages or losses suffered as a consequence of a breach of the Terms by another User or arising out of the use of or the reliance on any of the Services or the App. Availing loans carry a risk and you should speak with your trusted advisors and/or financial consultant before availing any debt of any kind, whether from CA Grameen or otherwise. In the event any exclusion contained herein is held to be invalid for any reason and we or any of our Affiliates, officers, directors or employees become liable for loss or damage, then, any such liability shall be limited to the loan amount availed by you.

11. USER DATA CONSENT

By using our digital platform, you acknowledge and provide explicit consent to the collection, processing and use of your personal data as outlined below:

Voter ID and Aadhaar Data:
We collect and process your Voter ID and Aadhaar information for the purposes of KYC verification, user authentication and fraud prevention. Your Aadhaar data is collected through offline Aadhaar Data Verification. You may require to use your Aadhaar information for the purpose of e-Signature in accordance with the process approved by UIDAI.

Spouse or Family Member Data (if applicable):
In certain cases, you may provide personal data related to your spouse or other family members. This information is collected to ascertain household’s outstanding credit and liabilities through a credit bureau verification as per regulatory requirement. You affirm that you have obtained necessary consents from your spouse or family members before providing their information.

Selfie:
We collect your selfie for facial recognition purposes to aid in identity verification and fraud prevention.

Location Data:
Your location data is collected to verify your geographic location for security, fraud prevention and to tailor our services to your region.

Personal and Business Profile Data:
Data you enter about your personal profile (marital status, education, etc.) and business profile (income, expenses, etc.) is used for credit assessment and to provide you with relevant financial services.

Bank Account Information and UPI VPA:
Your bank account information and UPI Virtual Payment Address (VPA) are collected for the purposes of disbursing funds and facilitating collections as part of our services.

Your consent to the above data collection and processing is crucial for us to provide you with our services effectively. We are committed to safeguarding your data and ensuring its secure handling in accordance with the applicable laws and regulations. If you do not provide consent to the above data collection and processing, it might hinder our ability to offer you certain services or verify your identity accurately.

13. GENERAL PROVISIONS

a. Notification: We shall notify you of any relevant information pertaining to your use of the Services by push notification on the App, SMS, call, WhatsApp, instant messaging services or email or through any other means that we may deem appropriate. b. Disputes: These Terms and any action related thereto will be governed by the laws of India. Any disputes arising out of or related to the Terms, the App, or the Services shall be subject to the jurisdiction of the courts located in Bengaluru, Karnataka.
c. Assignment: You shall not assign or transfer any right or obligation that has accrued to you under these Terms, and any attempt by You to assign or transfer such rights and obligations, shall be null and void. We may assign or transfer any right or obligations that accrued in our favour, at Our sole discretion, without any restriction.
d. Waiver: Unless otherwise stated expressly, any delay or failure in our exercising any rights/remedies arising out of these Terms and/or other policies available on the App, shall not constitute a waiver of rights or remedies and no single/partial exercise of any rights or remedies, hereunder, shall prevent any further exercise of the rights/remedies by us.
e. Survival: You acknowledge that your representations, undertakings, and warranties and the clauses relating to indemnities, limitation of liability, repayment of loan, governing law and these general provisions shall survive the efflux of time and the termination of these Terms.
f. Severability: If any provision of these Terms is held illegal or unenforceable, the validity, legality and enforceability of the remaining provisions contained herein shall not in any way be affected or impaired thereby. Any such provision held invalid, illegal or unenforceable shall be substituted by a provision of similar import reflecting the original intent of the parties to the extent permissible under applicable laws.
g. Amendment: We reserve the right to change, modify, add to, or remove discounts, portions of these Terms at any time, subject to the policies of the Company and applicable regulations.
